1. About These Terms

These Terms of Service ("Terms") govern your access to and use of the talino.kids website, application, and related services (collectively, the "Service") operated by:

By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

2. Eligibility

You must be at least 16 years old (or the age of digital consent in your jurisdiction) to create an account. The Service is designed for parents and guardians to create stories on behalf of their children. Children may not use the Service directly without parental supervision.

3. Account Registration

• You may register using Google or Meta (Facebook) OAuth.
• You are responsible for maintaining the security of your account credentials.
• You must provide accurate information and keep it up to date.
• You may not create multiple accounts to abuse free credits or circumvent restrictions.
• We reserve the right to suspend or terminate accounts that violate these Terms.

4. The Service

talino.kids provides:

• AI-generated personalized bedtime stories based on input you provide (child's name, age, topic, mood)
• AI-generated illustrations in various art styles
• AI-generated audio narration of stories

Content is generated using third-party AI services (Anthropic, Replicate) and may vary in quality. We do not guarantee that generated content will be free of errors, inaccuracies, or inappropriate material, though we make reasonable efforts to ensure age-appropriate output.

5. Credits & Payments

5.1 Free Credits

Every new account receives 150 free credits. Free credits are non-transferable and have no cash value.

5.2 Credit Packs

Additional credits can be purchased in packs:

• Starter — 100 credits for $2.99
• Standard — 500 credits for $9.99
• Family — 1,500 credits for $24.99

Prices are in USD and may be subject to applicable taxes (VAT). We reserve the right to change pricing with reasonable notice.

5.3 Credit Usage

Credits are consumed when generating content:

• Story text generation — 10 credits
• Illustration per scene — 5 credits
• Audio narration per scene — 3 credits

Credit costs may change. We will notify you of any changes before they take effect.

5.4 Payment Processing

Payments are processed securely by Stripe, Inc. By making a purchase, you also agree to Stripe's Terms of Service.

5.5 Refunds

Purchased credits are generally non-refundable. However, if you experience a technical issue that prevents credit usage, contact us at privacy@talino.kids and we will review your case. EU consumers retain their statutory right of withdrawal within 14 days of purchase, provided that the credits have not yet been used (Art. 16(a) Consumer Rights Directive).

6. Content Ownership & License

6.1 Your Input

You retain ownership of the information you provide (child's name, preferences, etc.).

6.2 Generated Content

Stories, illustrations, and audio generated by the Service are created by AI models. You are granted a non-exclusive, worldwide, royalty-free license to use, download, print, and share the generated content for personal, non-commercial purposes.

You may not:

• Resell or commercially distribute generated content
• Claim AI-generated illustrations as your own original artwork
• Use generated content to train other AI models

6.3 Our Rights

We retain the right to use anonymized, aggregated data about Service usage to improve our product. We will never use your child's personal data for this purpose.

7. Acceptable Use

You agree not to:

• Use the Service to generate harmful, violent, sexually explicit, or discriminatory content
• Attempt to bypass content safety filters or prompt the AI to produce inappropriate material
• Use automated tools, bots, or scripts to access the Service
• Reverse engineer, decompile, or attempt to extract the source code of the Service
• Interfere with or disrupt the Service or its infrastructure
• Share your account or credentials with others
• Abuse the free credit system (e.g., creating multiple accounts)

We reserve the right to suspend or terminate your account and forfeit remaining credits if you violate these rules.

8. Availability & Modifications

We strive to keep the Service available but do not guarantee uninterrupted access. We may modify, suspend, or discontinue any part of the Service at any time. If we discontinue the Service entirely, we will provide reasonable notice and refund unused purchased credits (excluding free credits).

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

AI-generated content may contain errors, inaccuracies, or unexpected results. You are responsible for reviewing all generated content before sharing it with your child.

10. Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or goodwill, arising from your use of the Service.

Our total liability for any claim related to the Service shall not exceed the amount you have paid us in the 12 months preceding the claim. This limitation does not apply to liability that cannot be excluded under Austrian or EU law.

11. Third-Party Services

The Service relies on the following third-party providers:

• Anthropic (Claude) — AI story generation
• Replicate — AI image generation (Flux and other models) and audio narration
• Stripe — payment processing
• Google — OAuth authentication, Analytics, Ads
• Meta — OAuth authentication, Ads

We are not responsible for the availability, accuracy, or policies of these third-party services. Your use of their services is subject to their respective terms.

12. Account Termination

You may delete your account at any time from your account settings. Upon deletion:

• All personal data and child profiles will be deleted within 30 days
• Generated stories and illustrations will be permanently removed
• Remaining credits (free or purchased) will be forfeited
• Payment records will be retained for 7 years as required by Austrian tax law

13. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or via a prominent notice on the Service at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.

14. Governing Law & Disputes

These Terms are governed by the laws of the Republic of Austria, without regard to conflict of law provisions. For EU consumers, mandatory consumer protection laws of your country of residence apply where they provide greater protection.

Any disputes shall be submitted to the competent courts in Austria. EU consumers may also use the European Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
